Australia has recently strengthened its laws against wage theft. As of January 1, 2025, intentional underpayment of wages or entitlements is now a criminal offence. Employers found guilty can face up to 10 years in prison or significant fines, which can be the greater of three times the amount of the underpayment or up to $8.25 million for corporations.
These changes aim to protect workers, particularly young and casual employees, who are disproportionately affected by wage theft, and as a result there are now criminal penalties, stronger enforcement, and expanded small claims jurisdiction.
