Diversity and workplace flexibility meet at a specific point, which is the flexible working arrangement request. That process carries real obligations and it is where employers most often come unstuck.
Eligible employees can request a change to hours, patterns or location for reasons including caring responsibilities, disability, age, pregnancy, and family or domestic violence. An employer must respond in writing within the required period, can only refuse on reasonable business grounds, and must have genuinely tried to reach an agreement first.
The common failures are procedural rather than substantive. Refusing verbally. Not responding at all. Refusing without discussing alternatives. Treating it as a favour rather than a request with a process attached.
Each of those is a defect even where the underlying business reason was sound.
