How To Deal With Workplace Discrimination
People working out how to deal with workplace discrimination usually focus on whether to raise it. The more urgent question is how long they have, because the options close quietly.
Australian pathways carry different time limits, and they are shorter than most people assume. A general protections application involving dismissal has a very short window measured in weeks. Complaints to the Commission and to state bodies have their own periods, generally longer but still finite. Internal grievance procedures often set their own deadlines as well.
The practical consequence is that waiting to see whether it improves can cost you a pathway entirely, even where the underlying complaint is strong.
You do not have to decide to act in order to protect your position. Find out what the deadline is, then decide.
The Fair Work Ombudsman and the Australian Human Rights Commission publish the current limits. This is general information rather than legal advice, and obligations vary by state and territory.
