What Is Psychological Health And Safety In The Workplace
Psychological health and safety duty holders are the same as for any other work health and safety risk, and it is worth being precise about who owes what.
The PCBU. The person conducting a business or undertaking holds the primary duty, to ensure so far as reasonably practicable that workers are not exposed to risks to their psychological health. This is an organisational duty and it cannot be delegated away by contract.
Officers. Directors and senior decision makers have a personal duty of due diligence. That means actively acquiring knowledge of psychosocial risk, understanding the organisation’s operations, ensuring resources are available and verifying they are used. Signing off a policy is not due diligence.
Workers. Take reasonable care of their own psychological health and not to adversely affect others, and comply with reasonable instruction.
The officers duty is the one boards most often underestimate, because it is personal and it is about what you did to inform yourself.
Safe Work Australia sets out the model duties. Requirements vary by state and territory. This is general information rather than legal advice.
