Compliance management software in Australia is the system an organisation uses to run training, policies, records, incidents and risk against Australian law rather than an imported rulebook. What makes it Australian is not the vendor’s postal address. It is where the data sits, and whether the content reflects the obligations that actually apply here.
Data residency is the first thing worth asking a vendor about, because employee compliance records are personal information. Under Australian Privacy Principle 8, an organisation that discloses personal information to an overseas recipient must take reasonable steps to see that the recipient does not breach the Privacy Principles, and section 16C of the Privacy Act makes the disclosing organisation accountable for how that overseas recipient then handles it. Hosting in Australia does not remove the duty, but it narrows the surface you have to assess and evidence.
The second question is content. Australian work health and safety law is harmonised but not uniform. Victoria never adopted the model WHS Act and runs the Occupational Health and Safety Act 2004 instead, and Western Australia was the last to move, with its own Work Health and Safety Act 2020 in force from March 2022. A platform whose courses and policy content were written for another market, or for one state only, will quietly misdescribe the duty for part of your workforce.
Worth confirming before you sign anything:
- Where employee records are hosted, and who can reach them from outside Australia
- Whether course and policy content is written for Australian law and maintained as it changes
- Whether your state or territory regime is covered, not just the model laws
- Whether support sits in an Australian timezone on the day something goes wrong
