How To Overcome Disability Discrimination In The Workplace
For most people, the way to overcome disability discrimination at work starts with an adjustment request rather than a complaint. How that request is made and recorded shapes everything that follows.
Ask for the adjustment, not the diagnosis. You generally need to explain what you need changed and why it helps you do the job, not disclose your full medical history. Be specific. A modified start time, particular software, a change to how instructions are given.
Put it in writing. Even after a good conversation, follow up by email. It creates the record of what was asked and when, which matters if the answer later becomes no.
If it is refused, ask why in writing. The obligation runs up to unjustifiable hardship, and the burden of showing hardship sits with the employer. A refusal that cites inconvenience or precedent rather than genuine cost or disruption is worth questioning. Ask whether an alternative was considered.
Escalate if you need to. Internally first, then the Commission’s complaint process. The guidance on employee rights under the Disability Discrimination Act sets out where you stand. This is general information rather than legal advice.
